1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and PT. Langkah Cerdas Edukasi (“Company,” “we,” “us,” or “our”) concerning your access to and use of the Akademis.ai platform and its related services.
By accessing or using our platform, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the service.
2. Description of Service
Akademis.ai is a cloud-based campus management platform that provides modular, integrated solutions to support operational processes and PDDIKTI (Indonesian Higher Education Database) reporting for educational institutions.
Our services include but are not limited to:
- Student information management
- Academic administration
- Financial management
- Reporting and analytics
- Integration with government education databases
3. User Accounts and Registration
To access certain features of our platform, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.
4. Acceptable Use
You agree not to use the platform to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Transmit malicious code, viruses, or harmful components
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the platform’s operation
- Use automated systems to access the platform without permission
- Impersonate any person or entity
- Collect or store personal data about other users without consent
5. Intellectual Property Rights
The platform and its original content, features, and functionality are owned by PT. Langkah Cerdas Edukasi and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the platform for your educational institution’s internal purposes only.
You retain ownership of any data you upload to the platform. By uploading data, you grant us a license to use, store, and process that data solely for the purpose of providing our services.
6. Payment Terms
If you purchase a subscription to our platform, you agree to pay all applicable fees. Fees are billed in advance on a recurring basis (monthly, annually, or as otherwise specified).
Payment terms include:
- All fees are non-refundable except as required by law
- Failure to pay may result in service suspension or termination
- We reserve the right to change our pricing with notice
- You are responsible for all applicable taxes
7. Service Availability and Support
We strive to maintain high availability of our platform but cannot guarantee uninterrupted or error-free service. We may perform scheduled maintenance with advance notice when possible.
Technical support is provided according to your subscription level. Response times and support hours vary by plan.
8. Data Privacy and Security
Your use of the platform is also governed by our Privacy Policy. We implement industry-standard security measures to protect your data, but you acknowledge that no system is completely secure.
You are responsible for:
- Maintaining secure backups of your critical data
- Complying with applicable data protection laws
- Obtaining necessary consents from data subjects
9. Limitation of Liability
To the maximum extent permitted by law, PT. Langkah Cerdas Edukasi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the liability.
10. Indemnification
You agree to indemnify and hold harmless PT. Langkah Cerdas Edukasi, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the platform or violation of these Terms.
11. Termination
We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason, including breach of these Terms.
Upon termination:
- Your right to access the platform ceases immediately
- We will provide a reasonable period for data export
- We may delete your data after the retention period
- Outstanding fees remain due and payable
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the platform shall be resolved through good faith negotiations. If negotiations fail, disputes shall be submitted to the jurisdiction of the courts in Jakarta, Indonesia.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the platform.
Your continued use of the platform after changes become effective constitutes acceptance of the revised Terms.
14. Miscellaneous
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Entire Agreement: These Terms constitute the entire agreement between you and PT. Langkah Cerdas Edukasi regarding the platform.
